By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

WarmVistaOrchid offers upscale yacht charter services, including but not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

All services are contingent upon availability and weather conditions. We reserve the right to alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To make a reservation for a charter, you must:

  • Be at least 18 years of age
  • Provide truthful and comprehensive information
  • Submit the required deposit as specified in your booking confirmation
  • Consent to these Terms & Conditions

3.2 Confirmation

Confirmation of your booking occurs only after payment has been made and we issue a written confirmation. Service may be denied to anyone at our discretion.

3.3 Availability

All charters are subject to vessel availability and appropriate weather conditions. We will attempt to honor your preferred dates and times to the best of our ability.

4. Payment Terms

4.1 Pricing

All pricing is in € and includes all applicable taxes unless otherwise noted. Prices may be subject to change without notification.

4.2 Payment Schedule

  • Deposit: 50% of the total cost of the charter required at booking
  • Balance: To be paid 48 hours before the charter begins
  • Supplementary charges (if any): Payable upon charter completion

4.3 Payment Methods

Major credit cards, bank wires, and certified checks are acceptable forms of payment. We use secure, encrypted methods for processing payments.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full refund minus processing fees
  • 24-72 hours before departure: 50% refund
  • Less than 24 hours before departure: No refund

5.2 Weather Cancellations

If our captain deems weather conditions unsafe, we will offer to:

  • Reschedule your charter at no additional cost to the next available slot
  • Issue a full refund should rescheduling not be feasible

5.3 Mechanical Issues

If mechanical issues occur with your designated vessel, we will make an effort to provide an appropriate substitute. Should no substitute be available, a complete refund will be given.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to instructions from the crew
  • Use provided safety equipment as needed
  • Inform us of any medical conditions that could affect their safety
  • Remain within designated areas on the vessel

6.2 Prohibited Items

The following items are not allowed on board:

  • Glass containers
  • Illegal substances
  • Firearms or weapons
  • Excessive quantities of beverages (past moderate consumption)
  • Pets (unless pre-approved)

6.3 Conduct

Passengers are expected to behave in a courteous manner. We reserve the right to end a charter prematurely without a refund if passenger conduct endangers safety or interferes with others' enjoyment.

7. Liability and Insurance

7.1 Our Liability

Our obligation is limited to the sum paid for your charter. We are not responsible for:

  • Injuries due to passenger's own fault
  • Theft or damage to personal belongings
  • Indirect, consequential, or exemplary damages
  • Delays arising from weather or other uncontrollable factors

7.2 Insurance Coverage

Comprehensive marine insurance is maintained for all vessels and operations under our purview. Guests are liable for their own travel and personal insurance coverage.

7.3 Assumption of Risk

Engaging in our maritime services indicates acknowledgment of the inherent risks associated and an acceptance of responsibility for personal safety and well-being.

8. Modifications and Itinerary Changes

We retain the right to adjust itineraries, paths, or timetables due to weather, safety, or operational necessities. Comparable alternative experiences will be arranged whenever possible.

9. Force Majeure

We bear no liability for disruptions, alterations, or cancellations resultant from events beyond our control, which may include but are not limited to:

  • Harsh weather conditions
  • Natural disasters
  • Regulatory enactments
  • Port obstructions
  • Mechanical failures

10. Privacy and Data Protection

Your personal information is managed as detailed in our Privacy Policy. By engaging with our services, your consent to the use and collection of your data is assumed as detailed in said Policy.

11. Intellectual Property

Content housed on our website, such as text, visuals, emblems, and images, is shielded by copyright and trademark laws. Reproduction, distribution, or derivative creation without explicit consent is prohibited.

12. Governing Law
